What is Representative Authorisation?
If you are applying for the Digital Nomad Residence Authorisation from within Spain (UGE-CE route) as a freelancer, you may choose to have a representative (such as a lawyer or professional manager) handle the submission for you. This document legally empowers them to act on your behalf before the Spanish administration.
Why is it needed?
Under the Ley 28/2022 (Startup Law), applicants can apply for residence directly through the Unidad de Grandes Empresas (UGE). To ensure data protection and legal validity, the administration requires proof that the person filing the digital application has the authority to represent the applicant.
Required Documents
To satisfy this requirement, the following are typically needed:
- Authorization Form: A signed document (Model of authorization) specifically naming the representative and the applicant.
- Identification: A copy of the representative's DNI/NIE and the applicant’s Passport.
- Digital Certificate: If applying online, the representative usually uses their own professional digital certificate to sign the application alongside your authorization.
Translation and Legalization
- Apostille: If the authorization is signed before a notary outside of Spain, it must be apostilled. However, since this checklist item refers to applying from Spain, the document is usually a private Spanish form signed locally and does not require an apostille.
- Translation: Not required if the form is in Spanish (official templates are provided in Spanish).
Common Pitfalls
- Incomplete NIE Info: Ensure your NIE (if already issued) or Passport number on the authorization matches your application exactly.
- Missing Signatures: Both the representative and the applicant must sign the document.
- Expired ID: Ensure the identification documents provided for both parties are valid.
