Passport Requirements for Spain's Digital Nomad Visa

Requirement Overview

As a foundational element of your digital nomad employee application under the Startup Law (Ley 28/2022), you must provide a valid passport. This serves as your primary identification and proof of legal entry into the Schengen area.

Why It Is Needed

Under the framework provided by the Ministerio de Asuntos Exteriores, a valid travel document is mandatory for all non-EU remote workers wishing to reside in Spain. It is the basis for issuing your NIE (Número de Identidad de Extranjero) and your subsequent TIE (Tarjeta de Identidad de Extranjero) via the Policía Nacional.

Documentation & Evidence

To satisfy this requirement, you must submit:

  • A full copy of your current, valid passport.
  • The passport must have a minimum validity of at least 12 months at the time of application.
  • Evidence of legal entry into Spain (such as an entry stamp) if applying from within the country.

Apostille & Translation

  • Apostille: Passports do not require an apostille as they are international travel documents.
  • Translation: Typically, the biographical page of the passport does not require a sworn translation if it contains English or Spanish. However, supporting certificates (like clean criminal records) definitely require them.

Common Pitfalls

  • Expiration Date: Applying with a passport that expires in less than 12 months can result in a rejection or a shorter residency grant.
  • Missing Pages: Ensure all pages (even blank ones or those with previous stamps) are scanned if requested by the specific consulate or UGE-CE office.
  • NIE/TIE Consistency: Your NIE and TIE will be linked to this passport number; if you renew your passport shortly after, you must update your records with the Policía Nacional.
