DNV Financial Evidence: Matching Payments and Contracts

Requirement Overview

For the Digital Nomad Visa (Ley 28/2022), freelancers must demonstrate that their incoming salary or invoice payments are clearly identified and perfectly match the terms stipulated in their employment or professional services contracts.

Legal Context

According to the Ministry of Foreign Affairs (Ley 28/2022), applicants must prove a professional relationship of at least 3 months with non-Spanish companies and maintain an income level of approximately 200% of the SMI (Salario Mínimo Interprofesional).

Required Evidence

To satisfy this requirement, you should provide:

  • Bank Statements: Showing the actual transfer of funds from clients to your account.
  • Invoices: Corresponding to the periods shown in the bank statements.
  • Service Contracts: Signed agreements showing the terms of payment that align with the amounts received.
  • Income Totals: Evidence that the monthly sum meets the minimum threshold (around 200% of SMI).

Apostille and Translation

  • Apostille: Generally, financial bank statements do not require an apostille, but official government certificates of tax residency or registration might.
  • Translation: Since this is a Spanish process, documents not in Spanish must typically be accompanied by a sworn translation (Traducción Jurada) to be legally valid for the administration.

Common Pitfalls

  • Amount Mismatches: Net amounts received in bank accounts not matching invoice totals due to undisclosed fees or currency conversions. Ensure you explain these discrepancies.
  • Insufficient History: Providing less than the required 3 months of established professional relationship history.
  • Lack of Continuity: Large gaps between invoice dates and payment dates that suggest unstable income below the required SMI threshold.
