Under the Digital Nomad Visa (Ley 14/2013), if a foreign company employs a nomad residing in Spain and there is no bilateral agreement or the worker cannot remain in the home country's social security system, the employer must register with the Spanish Social Security (Seguridad Social). This process involves obtaining a NIF (Tax ID) for the company and a Contribution Account Code (CCC) to pay monthly contributions.
Registration is handled by the Tesorería General de la Seguridad Social (TGSS). While the employer is foreign, the contract must be adapted to Spanish labor law. Documents required usually include company bylaws and powers of attorney, which must be apostilled and translated by a sworn translator (Traductor Jurado).
A common mistake is assuming a private insurance policy replaces this requirement for employees. If the registration (Alta) is successful, the worker gains access to the National Health System (SNS). The registration remains valid as long as the employment continues. Failure to register the company often leads to visa rejection for 'cuenta ajena' applicants. Self-employed nomads (Autónomos) register themselves via RETA and do not need this specific employer registration.
