Employer's Authorization Letter for Remote Work

The Employer's Authorization Letter is a critical document for the Spanish Digital Nomad Visa. It must be issued on official company letterhead and signed by a legal representative. The letter must state: the employee's position, seniority (at least 3 months), salary, and a clear statement authorizing the employee to perform their specific job functions remotely from Spain. It should also mention the duration of the contract or state it is indefinite.

Since the UGE-CE requires proof that the work can be done remotely, the letter must explicitly confirm this possibility. Regarding formalization: if the company is non-Spanish, the document must be legalized (usually via Apostille) unless an exception applies, and accompanied by a sworn translation (Traductor Jurado) into Spanish. The letter should be issued no more than 30–90 days before the application.

Common errors include: omitting the explicit mention of 'Spain', missing the signature of a verifiable representative, or failing to align the salary mentioned with the submitted pay slips. Note that for social security, if there is no bilateral agreement, the applicant often registers as an 'Autónomo' (RETA), providing access to the National Health System (SNS) without needing additional private insurance for the residency itself.
