Registering with Hacienda (Modelo 036/037) for Digital Nomads

What is this Requirement?

Registering with the Spanish Tax Agency (Agencia Tributaria) using Modelo 036 (Standard) or Modelo 037 (Simplified) is the first formal step to becoming an autónomo (self-employed worker) in Spain. This process notifies the government of your professional activity, the taxes you will pay, and your business address.

Why it is Needed

Under the Startup Law (Ley 28/2022) and Social Security regulations, freelancers must register their economic activity to legally invoice and pay taxes in Spain. This is mandatory for anyone spending more than 183 days in the country (becoming a tax resident) or whose main economic interests are in Spain.

Documents and Evidence

To satisfy this requirement, you must provide the “Modelo 036/037 - Declaración Censal” document stamped or digitally signed by the Agencia Tributaria. Prerequisites include:

  • A valid NIE (Foreigner Identification Number).
  • A Spanish bank account (recommended for tax payments).
  • An electronic certificate or Cl@ve for digital filing.

Apostille and Translation

Since the Modelo 036/037 is a Spanish document issued by the local authorities, it does not require an apostille or translation for use within Spanish administration. However, your foreign professional contracts used as support for the Digital Nomad Visa application must still be translated/apostilled as per general visa requirements.

Common Pitfalls

  • Sequence Error: You must register with Hacienda before or simultaneously with your registration in Social Security (RETA).
  • Deadlines: You must register with Social Security within 60 days before starting activity.
  • Beckham Law Confusion: Most autónomos cannot apply for the Beckham Law (fixed 24% rate) unless they meet specific recent reforms for digital nomads; verify eligibility via Modelo 149 within 6 months of your Social Security registration.
