What is the NIE?
The Número de Identidad de Extranjero (NIE) is a unique, personal identification number assigned to non-Spanish citizens. It serves as your tax and administrative ID for life in Spain.
Why is it Required?
Under the regulations provided by the Policía Nacional and Seguridad Social, a NIE is the prerequisite for all economic and legal activities. Specifically for the autónomo_setup profile:
- It is step #1 for registering with Hacienda (Tax Agency) using Modelo 036/037.
- It is mandatory for registering with Seguridad Social (RETA) to pay contributions.
- It is required to open a local bank account and sign contracts.
Required Documents and Evidence
To satisfy this requirement according to the Policía Nacional, you typically need:
- Form EX-15: The standard application form for the NIE.
- Valid Passport: Original and a full photocopy.
- Proof of Economic Interest: Documentation showing you are applying for the Digital Nomad Visa (Ley 28/2022) or intend to start a professional activity.
- Form 790-012: Proof of payment of the administrative fee.
Legal Formalities (Apostille & Translation)
While the NIE application itself is a Spanish process, any supporting foreign documents (like professional contracts or degrees used to prove the 'nomad' status) must generally be officially translated into Spanish by a sworn translator (traductor jurado). Foreign public documents must also bear the Apostille from the issuing country.
Common Pitfalls
- Cita Previa Scarcity: Appointments at the National Police stations are limited and must be booked in advance via the official online system.
- Sequence Error: Attempting to register as an autónomo or with the Tax Agency before having the physical NIE document will result in rejection.
- Expiry vs. Validity: While the NIE number itself never expires, the physical certificate issued might need to be 'active' for certain bank procedures.
